Respecting the child's opinion in divorcing procedure TV TELMA

TV TELMA 25th June 2012 Statement Dragi Zmijanac According to the information we get and the calls on the SOS helpline for children and youth 0800 12222 at the First Children's Embassy in the world Megjashi, in 2010 most of the calls refer to the divorcing procedures. Our direct service for help and support of the children noted/noticed that the most common reason for divorce is not some third person, but the bad communication between the parents. Also there are noted complains by the other parent who hasn't got the custody for the child and realization of the right to see the child. They usually insist, the place of taking/ undertaking of the child, to be neutral. In cases with bad communication between the parents, there is bad communication also in the divorcing process. It affects negative on the psychological and physical development of the child. Often, the parents, while arguing, do not take serious the best interests of the child. The Centers for Social Work, do not consider the opinion of the child about who the child want to live with, and the emotional connection with one of the parents. This opinion of the child, according to Megjashi, should be considered since young age, from 6 years and up, and when the child turn 10, the social centers should be obligated to ask who the child want to live with. The pressure that either of the parents make to the child while making the decision, should also be considered. It is true that the children are like hypersensitive with special instinct as a radar and know what they want and what they feel, but they can also be manipulated very easy by the parent who is an idol in the child's eyes, and resource for existence. Using that close and strong relationship to the child, the parent often uses the children as his/her protector and defender, punishing the other parent. Unfortunately our SOS service, is facing this kind of problems where the parents are using their children for their own interests, very often. That is the reason why the opinion of the child should be taken under consideration, no matter his/her age, and also to be cheeked if the that opinion is his/her personal, or imposed. The Social Work Centers should respect the right of the child to have opinion about who he/she wants to live with, and consider it very serious, no matter the financial situation of the parent. The strong and good emotional connection on the child with the parent should be taken under consideration when the Centers for Social Work give recommendation on court. The First Children's Embassy in the world Megjashi , stands for equal custody of the child to both parents. The First Children's Embassy in the world Megjashi, always stands for the view/attitude, that the institutions should respect the principle of the best interest of the child. We believe that the equal custody to both parents will help the child to have equal relation and communication with both parents, who will take proper care for the child and monitor the development of the child. This will prevent one of the parents to be aligned, or the parent with the right to see the children usually short time such as weekends, to try to get the naklonetost by the child, with buying him/her expensive gifts. In this case there will be continuous care for the child by the both parents, and the parent that has the custody will not be put in hard position to face all those challenges and problems. We expect monitoring by the Center for Social Work of the realization of the parenthood of the both parents, and revision of the condition every 6 months, with possibility for changes of the custody or the right of the parents to see the child, and obligated consultation with the child and taking under consideration the Child's opinion. Children are also victims to the late decisions for custody and right of seeing, and sometimes they must see the parent against their will, with one of the parents that they do not have a good emotional connection with. More and more often we are evidences to the arguing of the parents about who is going to take the custody for the child, not taking care of the child's interest and opinion and manipulating the child. That is why the professional social teams should respect every statement of the child and monitor the realizing of the right of seeing the child by one of the parents, and check if the child gave a statement for abuse in time, and check if the child is under pressure by one of the parents.
